The Grievance officer shall be available between 10 am to 6 pm IST from Monday to Saturday excluding Sunday and public holidays in India.
In no event we will be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including without limitation any loss of profits arising from your use of our website, our services, or inaccuracies of data, content, information, materials provided by you, even if we have been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited only to the extent of the amount paid by you to us towards our services.
You agree to indemnify and hold us, our directors, subsidiaries, affiliates, officers, employees, agents and business partners, harmless from any loss, liability, claim or demand, including reasonable attorney's fees, made by any third party due to or arising out of your violation of these Terms of Use, Privacy Policy, and/or your violation of third party rights, including but not limited to, infringement of intellectual property by you or any other user of your account and any other right of a person or entity.
By engaging with us and/or submitting your personal data to us through the forms on our website, you hereby agree to the collection, use, disclosure and/or processing of your personal data by us and/or our related corporations and affiliates for any or all of the following Specified Purposes:
a) You agree, understand and acknowledge the nature of services we provide, the terms and conditions applicable therefor and was given ample time & an opportunity to resolve all your queries, if any, with regards to the same.
b) You authorize us to send SMS or call to the registered number/E-mail ID including but not limited to confirmation of your appointment for our services, testimonials etc. You hereby agree that such SMS sent and/or call made would not be considered as a violation of the TRAI regulations even if you are registered under the DND list.
c) You shall permit our representative to access and reasonably use your premises if they deem necessary. You shall also permit and allow access to them to use any facilities on the premises and shall co-operate with and provide them, from time to time, any additional assistance or resources that they may require for providing services to you.
d) Services will be activated only after proper verification of information, documents including your financial standing, duly filled Customer Application Form, Photo, Proof of Identity (PoI) and Proof of Address (PoA) documents (as described by the Government from time to time) submitted by you. In the event of any incomplete and/or incorrect information being provided & or furnished, we reserve a right to reject, cancel, terminate and or suspend the services in whole or in part with/without prior notice.
e) You shall not re-sell the services procured from us to any third party.
f) You shall provide necessary assistance to us, TRAI, DOT or any other Government Agencies to counteract any unlawful activity.
g) You are responsible for any data that is sent or received by you and/or any other party in connection with your use of the Service. You agree that we are not responsible and will not be liable to you or any others for any loss or damage due to your use of the services.
h) All prices are exclusive of tax, taxes will be payable extra at applicable rates. Any change in Tariffs/Regulation from Telecom Regulatory Authority of India (TRAI) would be applicable with immediate effect.
i) We shall be entitled to suspend /terminate the service/s (whether temporarily or permanently) to recover all outstanding and dues from you, without prejudice to, and in addition to any right or remedy available to us, under any applicable law, if:
- the License is suspended/terminated temporarily or otherwise vide Governments, Court's orders, TRAI's rules, regulations, orders, directions, notifications etc., including changes thereto prohibiting and/or suspending the rendering of such services.
- transmission limitations caused by topographical, geographical, atmospheric, hydrological and/or mechanical conditions.
- during technical failure, modification, up gradation, or variation, relocation, repair and/or maintenance of the network/equipment.
- to combat potential fraud, sabotage, wilful destruction, etc.
- service is used in any manner, which violates any law or Government order/directions etc., or adversely affects or intervenes in any manner, the rendering of service by us.
- at any time, you fail to satisfy requisite credit check.
- you are in breach of any other provision of these terms and conditions or is declared insolvent/bankrupt/liquidated/dissolved or a Trustee or Receiver is appointed to take over your assets.
- The provisions of service/s (or any of them) to the subscriber adversely affects our network or equipment or the provision of service/s to you are revoked, discontinued or suspended.
- usage of equipment by you are not traceable or valid on our Network.
j) Any reconnection of service/s shall be done at our sole discretion and fulfilment of other conditions as specified by us.
k) You shall remain liable for the charges during the period of suspension of services.
l) If applicable, refunds will be processed only all the required documents are submitted by you after recovery of material. Refund will be processed within 45 working days from the date of material recovery and receipt of document whichever is later. All refund amounts will be calculated after deducting the tax amount and the cost of any non- recovered or non-operational materials received from you.
m) Any refund if applicable will be paid within eight weeks from the date of receipt of all requisite details and information. Account termination will be done on receipt of our owned equipment and settlement of all balance outstanding, charges /damages (if applicable) will be deducted from refund amount.
a) You shall be responsible for the accuracy and correctness of information furnished in the website and/or registration form with regards to our consultancy.
b) You will not indulge in any manner in any activity that will impact the brand image or create doubt or disparage us and/or our officers, managers, users, directors, employees, successors, assigns, subsidiaries, affiliates, suppliers, and representatives in the minds of the public at large.
a) You understand and agree that it is required by practise and standard of care to keep records of audio and/or video communication happen between us which shall be used for our internal training purpose and in order to assist you better. You hereby give your consent to record the audio and/or video communication between us.
b) Information contained in the recordings are of confidential in nature and we shall make every endeavour to maintain the confidentiality of information as such. We shall not disclose the information to any person and entity other than our employees, authorised representatives, consultants and business associates who need to access such information for providing the consultancy unless otherwise mandated by law.
You may opt for sharing your testimonials with us with regards to our services and authorize us to use the same for promoting our brand image or for any other lawful purpose. You acknowledge and affirm that we shall be the owner of copyrights of the said testimonials. In addition, you waive off any right to inspect or approve the finished product, including written copy, wherein your likeness or testimonial appears. You hereby hold harmless and release us from all claims, demands and causes of action which you, your heirs, representatives, executors, administrators or any other persons acting on your behalf or on behalf of your estate have or may have by reason of this authorization.
We reserve the right to modify the Terms of Use periodically, for any reason, and without notice. Please review this Terms of Use often so that you are apprised of any changes made therein. Any such revision or change will be binding and effective immediately on release of the revised Terms of Use on our website. Unless we expressly notify otherwise, these Terms of Use incorporate and supersede any other terms and conditions associated with regards to use of our website.
We control and operate website from our headquarter at Ahmedabad, India and make no representation that the materials on the website are appropriate or available for use in other locations. If you use this website from other locations, you are responsible for compliance with applicable local laws including but not limited to the export and import regulations of other countries. Unless otherwise explicitly stated, all marketing or promotional materials found on this website are solely directed to individuals, companies or other entities located in India and comply with the laws prevailing for the time being in force in India. This Agreement shall be deemed to have been executed at Ahmedabad, India. You unconditionally agree that all such disputes and / or differences arising out of or relating to use and/or access of the website and/or our services and/or Terms of Use shall be governed by the Laws of India and submitted to the exclusive jurisdiction of the court in Ahmedabad, India.
